When does the Divorce proceed or the dissociation of Free Union?
Divorce or dissociation of free union proceed in the following cases:
- On the court proceeding:
- By a rupture of the common life project,
- By the agreement of the parts or at will of one of them;
- On the notarial route:
- When there is a mutual agreement and there are not daughters or sons or the ones would be older than twenty-five (25) years old,
- When there are no profit assets attached to registration; and
- It exists an express waiver in any form of family assistance from any of the partners.
- It arranges before the Public Faith Notary of the last conjugal home, with the subscription to a divorce regulating agreement.
When can a Divorce be done before a Public Faith Notary and what it's the procedure?
You can have a divorce before a Public Faith Notary in the following cases:
